Diligence
The Firm
supervises environmental due diligence, Phase I – IV reviews and
environmental audits. The Firm works with, and can recommend a wide
variety of environmental consultants, and assists its clients with
counseling on statutory and regulatory provisions, including reporting
requirements.

associated with these transactions. Included are negotiating, and
drafting purchase, lease, financing and other agreements to deal with
such risks. The Firm strives to structure transactions with the goal of
minimizing individual and corporate environmental liability.
As
many clients have discovered, in 1986 Congress amended the Superfund
law (the SARA Amendments) to require purchasers of real estate to
perform a minimal environmental inspection of their property prior to
purchase. Accordingly, environmental “auditing” by attorneys and
environmental consultants is the norm. The Firm’s environmental
practice provides counseling to facilitate both complex and everyday
environmental, real estate transactions.
The Firm also has experience in obtaining and negotiating environmental
insurance coverage for just about any need, including pollution legal
liability, pollution cap and comprehensive, and wrap-around insurance
policies for its clients’ environmental and real estate needs.
